Property developer contract

A contract for the acquisition of property still to be built or substantially renovated, involving advance payments; governed by the Developer Contract Act (BTVG).

In brief

A property developer contract exists where the purchaser makes payments before completion for a property that is yet to be built or fundamentally renovated. The Developer Contract Act (BTVG) protects these advance payments and prescribes the form, minimum content and security obligations.

The developer must secure the purchaser’s payments, for instance through the contractual or land-register security model or through a payment schedule tied to construction progress. A trustee monitors compliance. This clearly distinguishes the developer contract from a simple contract for works.
