CE marking and the declaration of performance create technical transparency. They do not automatically mean that a construction product suits every concrete project.

If moisture, cracks, fire-safety or sound-insulation problems appear later, product data, planning, order and installation must be reviewed together.

This article explains how construction products, CE marking, defect and liability interact in Austrian construction law.

Overview of all answers.

01

Prepare review

CE marking and the declaration of performance create technical transparency. They do not automatically mean that a construction product suits every concrete project.

If moisture, cracks, fire-safety or sound-insulation problems appear later, product data, planning, order and installation must be reviewed together.

02

Respond specifically

The declaration of performance describes declared characteristics of a construction product. It does not replace the question of what performance was contractually owed and how the product was used.

Where damage occurs, it must be clarified whether the product itself was defective, whether it was planned incorrectly or whether workmanship was wrong.

03

Close documents

Anyone who removes a product immediately often loses decisive evidence. Photos, batch numbers, packaging, delivery notes, test reports and samples may matter later.

Declaration of performance is not defect-free status

The declaration of performance describes declared characteristics of a construction product. It does not replace the question of what performance was contractually owed and how the product was used.

A product may be formally marked and still be unsuitable in the concrete installation. Planning, technical specifications, substrate, workmanship and intended use matter.

Therefore review data sheet, declaration, order, plan and installation record together.

Separate installation errors and planning errors

Where damage occurs, it must be clarified whether the product itself was defective, whether it was planned incorrectly or whether workmanship was wrong.

This distinction determines against whom warranty or damages claims can be directed. Supplier, contractor, planner and site supervision may have different roles.

Premature blame makes evidence harder. First secure the technical cause in a traceable way.

Secure evidence before replacement or removal

Anyone who removes a product immediately often loses decisive evidence. Photos, batch numbers, packaging, delivery notes, test reports and samples may matter later.

For larger damage, expert findings should be considered before removal. In suitable cases the other side should be given an opportunity to inspect.

Documentation is especially important where several contractors worked on the component one after another.

Checkpoints

Product error, planning error or installation error

Liability depends on where the error arose.

Product error, planning error or installation error
Checkpoints What it concerns Why it matters
Product Declared performance, batch and technical data May concern claims against supplier or manufacturer.
Planning Specification, suitability and tender May concern planner or client.
Installation Substrate, workmanship and control May concern contractor, site supervision or several trades.

The concrete classification depends on the individual case and the file status.

FAQ

Construction products and CE marking: declaration of performance, defect and liability.

Is CE marking enough against defect claims? +

No. CE marking and declaration of performance describe declared product characteristics but do not replace the contractual defect review.

Who is liable for an unsuitable construction product? +

That depends on whether product, planning, selection or installation was wrong. Supplier, contractor and planner must be reviewed separately.

Should a defective product be removed immediately? +

Only where safety or mitigation requires it. Otherwise evidence, samples, photos and product data should be secured before removal.
