Describe the window or door defect specifically

A useful defect notice does not merely state that a window leaks. It describes where draught, water, condensation, warping or fitting problems appear and when the defect was first noticed.

Photos, short videos, measurements, maintenance documents and correspondence help preserve the condition before repair. The condition of connection joints, seals and fittings is particularly important.

In business-to-business cases, the duty to give notice under section 377 UGB may also matter. Consumers should also react quickly in writing, even if that special rule does not apply in the same way.

Keep warranty and damages separate

Warranty under Austrian civil law is linked to the defect being present at handover. For buildings the warranty period is generally three years from handover.

Damages additionally require fault and may cover consequential loss such as moisture damage to interior finishes or furniture. Limitation must be reviewed separately.

The distinction decides which evidence is needed and whether remedy, price reduction, retention or compensation for consequential loss is central.

React correctly before repair is carried out

Quick repair can make sense, but it should not destroy evidence. Before seals, fittings or entire elements are replaced, the original condition should be documented.

Anyone withholding payment should state the reason and amount in a traceable way. A blanket retention can become a dispute in itself.
