Clarify protection duties during frost and moisture

The first question is what performance was owed. A general reference to bad weather does not replace review of contract, schedule, bill of quantities, standard references and actual execution.

Section 1168a ABGB is important because the contractor must warn if instructions, materials or circumstances from the client are recognisably unsuitable. Warranty and damages may also remain relevant.

Protection can include covering, heating, drainage, postponing specific works and preventing moisture penetration. Requests, refusals and instructions should be recorded in writing.

Secure evidence before the site condition changes

Evidence should be secured before drying, opening or repair. Otherwise the parties are often left with assertions about weather without traceable cause and responsibility.

This separation also helps at handover. Moisture damage, cracks, frost spalling or delayed drying must be classified as defect, obstruction or permissible schedule consequence.
