With a construction defect, time counts. The warranty for a building expires three years after handover under section 933 ABGB. Anyone who waits too long loses the simple remedies such as repair, price reduction and rescission and is left with the harder-to-enforce damages claim.
This calculator shows you whether the period is still running, how many days remain and how urgent the situation is. It takes into account the burden-of-proof presumption under section 924 ABGB, the special rule for obvious defects under section 928 ABGB and the duty to give notice under section 377 UGB. The result is an initial assessment and does not replace an examination of the individual case.
