A granted building permit is not an unlimited reserve. If works start too late or the project rests for a long time, the permit basis may be lost.

For owners this becomes serious once planning, financing and contracts are already running. The issue is no longer paperwork only, but stop order, new application and cost risk.

Why the timing of a permit must be reviewed

A building permit authorises a specific project within a legal framework. That framework concerns not only plan and conditions, but also the timeline after the notice.

Separate start of works, interruption and evidence

Not every preparatory step is already a legally relevant start of works. Offers, financing or planning do not replace actual implementation. Concrete works on site may be easier to prove.

Document when specific works began. Photos, site diary, site manager documents and invoices may matter if the start is later disputed.

Long interruptions should also be reviewed. The legal and factual status matters more than the owner’s continuing intention.

Prepare extension or new application in time

If consent may lapse, clarify before continuing whether an extension application is available and useful. It should not be prepared only after the problem has already materialised.

If the permit has already lapsed, a new application may be required. Then current documents, present legal status, development plan and neighbour rights have to be reviewed again.

A new application can also be the cleaner route if the project changed anyway. Plan deviations during construction are a separate risk.

Why continuing without secured consent is risky

Continuing despite a lapsed or doubtful permit can trigger authority steps. Old plans do not help if current consent is missing.
