In Salzburg, the building authority may inspect the execution of a construction measure during the works to determine whether it complies with building law and the building permit granted.

The affected parts of the site must be accessible for that purpose. The authority may request information from the persons named in section 11 BauPolG and, for special projects, require findings for checking structural strength or fire safety.

What the building authority may inspect on site

Section 15 paragraph 1 BauPolG authorises the building authority to inspect the execution of a construction measure for compliance with building law and the building permit granted. The reference point is therefore the current state of the works compared with the approved project.

The inspection is a separate stage of the building procedure. It addresses whether the works comply with the legal requirements while construction is in progress. It does not replace the notice of completion and occupation, and it does not automatically decide whether that notice is complete.

The statutory power is broadly framed. The authority’s officers must be given access to construction sites in all their parts at any time. Section 15 paragraph 1 therefore does not limit an inspection to one visible area. The precise subject still depends on the project and the authority’s approach.

Which information and findings may matter

The building authority may request information from the persons listed in section 11 BauPolG. Preparation should therefore identify who can explain the technical execution, who knows the plan status and who manages the building file. During the inspection, keep the building permit, approved plans and understandable records of the current state available. These documents provide a practical basis for the discussion. Additional documents depend on the project, the permit and the specific request.

For a special type of construction measure, the authority may require the building owner to provide findings if it considers them necessary to check structural strength or fire safety. Section 15 paragraph 1 gives load tests as an example. Record the requested finding, the affected elements and the requested timing precisely.

How to prepare the inspection in practical terms

Start with a simple comparison: Which plan was approved, which part is complete and which works are still under way? Mark changes with the building element, date and document that records the change. This allows the information to distinguish the approved state, later planning and actual execution.

Also make safe practical access to the affected parts of the site possible. Preparation should not reduce the inspection to a representative room if other parts of the works are involved. Construction-site safety remains a separate question from the authority’s inspection power.

After the appointment, keep minutes of the persons present, information requested, documents handed over and specific findings. State only what was actually discussed or provided. A separate legal assessment can follow afterwards.

What to clarify when deviations are found

If the authority identifies a deviation, first clarify which part of the execution and which permit or rule are concerned. A general statement that the building is different says little about the next step. The element, plan version, state of execution and precise official finding matter.

Do not change the works prematurely before the finding and the related documents have been secured. Whether a change is permitted, requires an amendment to the filing or has another consequence depends on the case. An inspection during construction must be distinguished from a later procedure about a deviation from the plan.

Section 15 paragraph 2 BauPolG also contains a specific power concerning machines that cause unlawful noise. The authority may prohibit further use in the relevant construction measures where the statutory requirements are met. That possible measure concerns a specific noise situation and is separate from the general review of documents.
